DUI/DWI Penalties Can Affect You For Years
A first DUI/DWI offense is a Class 1 misdemeanor, not a traffic ticket. It is the highest level misdemeanor offense we have in Virginia. If you are convicted, you will have a crime on your record and it will not be eligible for expungement. In addition, your driver’s license will be suspended, you will be required to install an ignition interlock system in your car, and your auto insurance rates may rise.

A First DUI Offense Is Serious
If you are convicted of a first-time DUI/DWI offense, the following penalties may apply, depending on the specifics of the case:
- Mandatory minimum fine of $250
- Driver’s license revocation for one year
- Alcohol treatment and/or education classes
- Potential jail sentence, including mandatory jail for high BAC results
- Ignition interlock device installed on your vehicle
With our experience, we know how to investigate DUI/DWI cases. We know how to find defenses to your case through a well-reasoned application of the facts of your case to the existing law. We will thoroughly review all the evidence in your case, including the criminal complaint, witness statements, police videos and the arrest reports if available, Breathalyzer results, breath test machine maintenance records, and field sobriety tests. If the police violated your rights or the testing conditions were questionable, we may be able to argue for the suppression of the resulting evidence. In some cases, this may result in the reduction or dismissal of the charges against you.
